Terms of Service
These Terms of Service ("Terms") govern your access to and use of the AviaCost platform, website, and related services (collectively, the "Service") provided by AviaCost, LLC ("AviaCost," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and capable of entering into a legally binding agreement to use the Service. By using the Service, you represent and warrant that you meet these requirements. The Service is intended for business professionals in the aviation industry and is not designed for general consumer use.
2. Account Registration
To access the platform, you must register for an account. You agree to provide accurate, complete, and current information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at hello@aviacost.com if you suspect unauthorized access to your account.
3. Subscription Plans and Payment
3.1 Plans
AviaCost offers multiple subscription plans (Monthly, Annual, Fractional, and AviaCore) as described on our Pricing page. Plan features and pricing are subject to change with reasonable notice.
3.2 Billing
Subscription fees are charged in advance on a recurring basis (monthly or annually, depending on your plan) via the payment method you provide. All fees are in U.S. dollars and are non-refundable except as expressly stated herein.
3.3 Free Trial
We offer a 3-day free trial with full platform access. No credit card is required to start a trial. Trials automatically expire at the end of the trial period unless you elect to subscribe.
3.4 Cancellation and Refunds
Monthly plans may be cancelled at any time and will remain active through the end of the current billing period. Annual plans are non-refundable after 14 days from the start of the subscription term. To cancel, contact hello@aviacost.com.
4. Permitted Use
Subject to these Terms and payment of applicable fees, AviaCost grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes. You may not:
- Share your login credentials with individuals not authorized under your plan
- Scrape, crawl, or systematically extract data from the platform
- Reverse engineer, decompile, or disassemble any part of the Service
- Resell, sublicense, or redistribute platform data or outputs without our written consent
- Use the Service in any way that violates applicable laws or regulations
- Use the Service to compete directly with AviaCost by building a substantially similar product
5. Intellectual Property
The Service, including all content, software, data models, cost methodologies, AviaIntel report formats, design elements, and branding, is owned by AviaCost or its licensors and is protected by intellectual property laws. Nothing in these Terms transfers any ownership rights to you. You retain ownership of any data you submit to the platform; by submitting such data, you grant AviaCost a limited license to use it to provide and improve the Service.
6. Data Accuracy Disclaimer
AviaCost provides aircraft operating cost data, market intelligence, and financial modeling tools for informational and professional reference purposes only. While we strive for accuracy, all cost data, projections, valuations, and analyses are estimates based on available data and methodologies. AviaCost makes no warranty that the data is error-free, complete, or appropriate for any specific transaction or decision. You should independently verify all data before relying on it for acquisition, investment, or operational decisions. AviaCost is not responsible for losses or damages arising from reliance on platform data.
7. Confidentiality
You agree to treat any non-public information about the Service's methodologies, pricing structures, data sources, and platform architecture as confidential. AviaCost will treat your account data and submitted information as confidential in accordance with our Privacy Policy.
8. Warranty Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AVIACOST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE. IN NO EVENT SHALL AVIACOST'S AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to defend, indemnify, and hold harmless AviaCost, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, violation of these Terms, or infringement of any third-party rights.
11. Termination
We reserve the right to suspend or terminate your account at any time, with or without cause, upon notice. Grounds for immediate termination include material breach of these Terms, fraudulent activity, or conduct that poses a risk to other users or the platform. You may terminate your account at any time by contacting us. Upon termination, your license to use the Service ceases immediately.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of Wisconsin, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved by binding arbitration in Milwaukee, Wisconsin, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.
13. Changes to Terms
We may modify these Terms at any time. We will notify registered users of material changes by email. Continued use of the Service after changes become effective constitutes acceptance. If you do not agree to the updated Terms, you must stop using the Service.
